1. Compliance with These Terms and Conditions

1.1 Please read these terms and conditions carefully. By using The Lad Collective (TLC) website (theladcollective.com) (“Site”), including any of the functions available on the Site, you agree to be bound by and comply with these terms and conditions (“Terms”) and our Privacy Policy.

2. General

2.1 The Site is a retail shopping (including e-commerce) platform where you can browse, select, and order goods advertised by The Lad Collective Pty Ltd (referred to as “TLC”, “we”, “us”, or “our”).

2.2 If you are under 18 years of age, you must obtain your parent or guardian’s consent before accessing and using the Site.

2.3 Your access to and use of the Site, including your order of goods, is subject to these Terms and the Privacy Policy available on the Site.

2.4 These Terms also apply to the sale of any goods via methods other than the Site, including sales made via telephone, in person, through third-party platforms, or other means, unless otherwise agreed in writing.

3. Promotions & Special Offers

3.1 General Terms

• Promotions cannot be used in conjunction with other offers unless otherwise stated.
• All offers are subject to availability and may be modified, extended, or canceled at any time without prior notice.
• “Select deals available on site” refers to specific promotions that may be combined with these offers. Eligibility is determined at checkout and subject to change.
• Free gifts, discounts, and promotional items are not redeemable for cash or credit.
• If an order is returned and no longer meets the promotional threshold, the free gift must also be returned. If not, the value of the free gift will be deducted from any refund issued.
• Any order containing a pre-ordered item will be shipped as a single shipment once all items are ready to dispatch.
• All promotions are valid only while stocks last. Once stock is depleted, the offer will no longer be available.

• Up to 50% off select items while stocks last. Prices as marked, no promo code required.
• Sale items are not eligible for returns unless deemed faulty under Australian Consumer Law.
• This promotion may be used in conjunction with select deals available on site.*
  
• If returned items cause the order to fall below the promotional threshold, the discounted set will be revalued at full price and refunds adjusted.
• This promotion is subject to availability and may be modified or cancelled at any time without notice.
• Discount automatically applies to the lowest-priced eligible Bedding Set in the cart.

Newsletter Sign-Up Offer

• New customers who sign up for our newsletter via the website pop-up form will receive a 10% discount code via email.
• A minimum spend of $100 is required to redeem this offer.
• This offers cannot be used in conjunction with other offers.
• 10% off website pop-ups will not display during peak promotional periods. 

4. Disclaimer

4.1 The information contained on the Site is provided in good faith on an “as is” and “as available” basis. TLC does not represent or warrant the accuracy, reliability, or completeness of the information contained on the Site.

4.2 To the extent permitted by law, TLC is not responsible or liable for any direct, indirect, or consequential loss arising from:

• Errors in, or omissions from, the information contained on the Site.

• Use of any goods ordered or acquired via the Site.

5. Intellectual Property

5.1 All material on the Site, including but not limited to text, images, graphics, and product descriptions, is the intellectual property of TLC and is protected by copyright and trademark laws.

5.2 You may not modify, copy, reproduce, distribute, or exploit any content from the Site for commercial purposes without prior written consent from TLC.

6. Changes to These Terms and Conditions

6.1 If you have an order that has been accepted by us, the terms and conditions that apply to that order are those that were in place at the time of purchase.

6.2 We may modify these Terms at any time. Updates will be posted on the Site, and continued use of the Site after modifications means you accept the updated Terms.

7. Pricing & Payment

7.1 All prices displayed on the Site are in Australian Dollars (AUD) and include GST unless otherwise stated.

7.2 TLC reserves the right to update product pricing at any time without prior notice.

7.3 Payment methods accepted include credit/debit cards, PayPal, Afterpay, and other methods as listed on the Site. Payment must be made in full before an order is processed and shipped.

8. Shipping & Delivery

8.1 Delivery Timeframes

TLC aims to deliver all in-stock orders within 5–7 business days for non-pre-order items. Delivery times vary depending on the shipping address and carrier delays.

8.2 Shipping Costs

Shipping is free on all orders, Australia-wide. No additional fees apply for standard shipping.

8.3 Tracking

Customers will receive a tracking number once their order has been dispatched.

8.4 Lost or Delayed Shipments

TLC is not responsible for delays caused by couriers or external factors beyond our control. However, if you experience any issues, please contact our customer service team for assistance.

8.5 International Shipments

• Import duties, VAT/GST, and any customs clearance fees are not included in your order total.
• These charges are set by your local government and are payable upon delivery.
• We cannot estimate or cover these costs.

9. Returns, Exchanges & Refunds

9.1 Returns

• TLC offers a 90-night trial on eligible products. If you’re not satisfied, you may return your order within this 90-day period.
• To qualify for a return under the 90 Night Risk-Free Trial, items must be either:
  • Unused and in their original packaging, or
  • Used and washed (washing is required before returning).
• Please note: Laundry sheets are not eligible for return under the 90 Night Risk-Free Trial. Returns for laundry sheets will only be accepted if the product is faulty (see section 9.3).

9.2 Exchanges

• Exchanges (e.g., a different colour or size) are available within 30 days of the original purchase date.
• To be eligible, the item must be unused, unwashed, and in original packaging.
• Used or washed items are not eligible for exchange under any circumstances.
• Note: The 90 Night Risk-Free Trial applies to returns only, not exchanges.
• Laundry sheets are excluded from all exchanges unless faulty.

9.3 Faulty or Incorrect Products

• If you receive a faulty or incorrect product, please contact our customer service team within 14 days of receiving your order.
• TLC will arrange a replacement or refund, depending on the situation.

9.4 Refund Process

• Approved refunds will be processed via the original payment method used at the time of purchase.

10. Loyalty & Rewards Program

How to Earn Points

You can earn TLC Loyalty Points through the following activities:

• Earn 1 point for every $1 AUD spent on full-priced products, calculated on the order subtotal (excluding shipping and taxes) once the order is fulfilled.
  
• Create a TLC account – 50 points.
  
• Follow us on Instagram, Pinterest, or TikTok – 10 points each.
  
• Like our Facebook page – 10 points.
  
• Upload a photo review via Okendo – 30 points.
  
• Earn 250 points after every three qualifying purchases. Each qualifying purchase must be over $50.
• Birthday and anniversary bonuses – available according to your VIP tier status.
  

Please note: You must be logged into your TLC account to earn points. Guest checkouts will not accumulate points.

Redeeming Points

• You can redeem points in fixed increments at checkout:
  
  • 200 points = $10 off
  • 500 points = $25 off
  • 1,000 points = $50 off
  • 1,500 points = $75 off
  • 2,000 points = $100 off
• Minimum spend applies when redeeming loyalty points. Each reward tier has its own minimum spend requirement:
  
  • $10 off requires a $40 minimum spend
  • $25 off requires a $100 minimum spend
  • $50 off requires a $200 minimum spend
  • $75 off requires a $300 minimum spend
  • $100 off requires a $400 minimum spend
• The maximum redemption per order is $100 (2,000 points).
  
• Points may not be used in conjunction with other promotions or discounts unless otherwise specified.
  
• Points can only be redeemed on full-priced products and cannot be used on gift cards or during site-wide sale events (e.g., Black Friday).
  
  

Points Expiry

• Points earned through purchases or actions will expire two (2) years from the date of accrual.
  
• Birthday, anniversary, or tier-entry bonus points will also expire after two (2) years, unless otherwise specified.
  
  

VIP Tiers & Rewards

Your VIP status is determined by your total points earned over a rolling 24-month period:

• Tier 1 – Free to join
  
  • 50 points on sign-up

• Tier 2 – 846+ points
  
  • 150 entry bonus points

• Tier 3 – 1,410+ points

Tiers reset based on your rolling 24-month points activity. If you do not meet the threshold to maintain your current tier, your status will adjust accordingly.

Referral Program

• Your referred friend will receive $50 AUD off their first order over $300 AUD (full-priced products only).
  
• You will receive 1,000 points (equivalent to $50 AUD) once their qualifying purchase is completed.
  
• There is no limit to the number of friends you can refer.
  
• Referred friends must be new customers and not subscribed to our email or SMS lists.
  
• Referral rewards cannot be combined with other promotions or discounts and are not valid on sale products.
  
• Your reward points will be added only after the referred order has been fulfilled and not returned.
  
  

Account & Redemption Information

• You must have a TLC account and be logged in to earn or redeem points.
  
• Points and reward codes cannot be redeemed for cash or gift cards and are non-transferable.
  
• Only one discount may be applied per transaction. Minimum spend thresholds may apply and will be displayed during checkout.
  
  

Returns & Points

If an item is returned, any points earned from that purchase will be deducted from your account balance.

Changes to the Program

The Lad Collective reserves the right to modify, pause, or cancel the Loyalty & Rewards Program or these Terms & Conditions at any time without prior notice. Reasonable efforts will be made to communicate any significant changes.

11. Warranty

TLC stands behind the quality of its products and offers a 12-month warranty on all items that show a manufacturing defect, valid from the date of purchase.

Laundry sheets are excluded from this warranty and are only eligible for replacement or refund if faulty at the time of delivery.

11.1 What the Warranty Covers

• Defects related to workmanship or manufacturing that affect the product’s intended performance.

11.2 What the Warranty Does Not Cover

• General wear and tear, marks, stains, or discolouration from body oils, sweat, spills, or similar.
• Any damage resulting from incorrect care or failure to follow provided care instructions.
• Damage caused by pets or animals.
• The Lad Collective reserves the right to not replace your products if it is deemed as normal wear and tear.
• We will not regard goods as faulty if we believe they have been used in extraordinary situations or they have deliberately been tampered with.

11.3 Warranty Claims Process

To make a warranty claim:

• Submit photo evidence of the issue. We may ask for measurements or more details.
• We may request the item to be returned. If so, a prepaid return label will be provided at no cost.
• Once the fault is confirmed, TLC will replace the affected item only.
• We cannot guarantee the same colour will be available, especially for limited edition ranges.
• If the original colour is out of stock, an alternative will be offered.
  If you prefer a full set in a new colour, TLC will cover the value of the faulty item only. Any additional cost is your responsibility.

TLC reserves the right to decline a claim if the product shows signs of deliberate damage or has been used outside normal conditions.

12. Limitation of Liability

12.1 To the extent permitted by law, TLC is not liable for indirect or consequential damages, including loss of profits, data, or business opportunities arising from:

• Use or inability to use the Site.
• Delayed or failed delivery of products.
• Any third-party content or external links on the Site.

12.2 Our goods and services come with guarantees under the Australian Consumer Law. If a product has a major failure, you may be entitled to a refund, repair, or replacement.

13. Privacy & Security

13.1 By using the Site, you agree to the collection and use of personal information as outlined in our Privacy Policy.

13.2 TLC implements industry-standard security measures to protect customer data but cannot guarantee the Site is free from cyber threats.

14. Governing Law

14.1 These Terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of Australian courts.
